Hazardous Waste Transporters In-Transit Storage (or Transfer) Ppreparedness, Prevention, and Contingency (PPC) Plan

Transfer Facility Requirements

Regulations covering the storage and transfer of hazardous waste by transporters arefound at 263a.12. Transfer facility requirements.

In addition to the requirements incorporate by reference:

  1. A transporter storing hazardous waste at a transfer facility for periods of not more than 10 days but greater than 3 days shall prepare an in-transit storage preparedness, prevention and contingency plan in addition to the transporter contingency plan. This plan shall be submitted under section 403(b)(10) of the act (35 P.S. 6018.403(b)(10)) and approved in writing by the Department prior to the initiation of the storage.
  2. A transporter transferring hazardous waste from one vehicle to another at a transfer facility shall prepare an in-transit storage preparedness, prevention and contingency plan in addition to the transporter contingency plan. This plan shall be submitted under section 403(b)(10) of the act and shall be approved in writing by the Department.

If you have intentions of conducting these types of activities you must first submit, and receive written approval of, an in-transit storage preparedness, prevention and contingency (PPC) plan, from the DEP regional office serving the county in which the site is located. A separate in-transit storage PPC plan is required for each location.

This plan is not the same as the contingency plan required to obtain the hazardous waste transporter license. The In-Transit Storage PPC Plan includes a map and drawing depicting terminal location and layout, types of wastes to be held in in-transit storage, spill control measures, inspections, security, etc.

Hazardous waste transporters must increase the amount of their collateral bond by a minimum of $10,000 per transfer facility using the attached 10 – Day Transfer Facility Bonding Worksheet (Word) and Collateral Bond Endorsement (In-Transit Storage Facility) 2540-FM-BWM0619. Hazardous waste transporters that also want to temporarily store residual waste must post an additional bond using the attached worksheet (Word). A transfer facility may not be operated until the increased collateral bond and the PPC plan are approved.
