Gaming Act

The Pennsylvania Race Horse Development and Gaming Act (“Gaming Act”) may be found at 4 Pa.C.S. § 1101 et seq.  The Ethics Commission’s duties under the Gaming Act include:

1.           Biennially publishing the following lists:

(a)          A list of all positions of employment with the Pennsylvania Gaming Control Board and with independent contractors to the Pennsylvania Gaming Control Board that have duties which would cause people in those positions to be subject to certain “revolving-door/post-termination” restrictions set forth in Section 1201(h) of the Gaming Act;

(b)          A list of all state, county, municipal, and other government positions that meet the Gaming Act’s definitions of the terms “public official” or “executive-level public employee,” to identify people who would be subject to the financial interests and employment prohibitions of Section 1512 of the Gaming Act; and

(c)          A list of all positions with the Pennsylvania State Police, the Pennsylvania Office of Attorney General, and the Pennsylvania Department of Revenue that have duties which would cause people in those positions to be subject to the “revolving door/post-termination” restrictions of Section 1512.1 of the Gaming Act.

2.           Determining, upon request, whether someone would be subject to the financial interests and employment prohibitions or the “revolving-door/post-termination” restrictions set forth in Sections 1201(h), 1512, or 1512.1 of the Gaming Act.    

3.            Determining whether to extend deadlines for executive-level public employees, public officials, party officers or their immediate family members to divest themselves of financial interests that they would be prohibited from holding under Section 1512 of the Gaming Act.

Act 114 of 2016

Act 114 of 2016 created the State Horse Racing Commission to regulate the race horse industry in Pennsylvania.  Act 114 may be found at 3 Pa.C.S. § 9301 et seq.  Pursuant to Act 114, the State Ethics Commission is responsible for:

1.           Biennially publishing a list of all employment positions within the State Horse Racing Commission that have duties which would cause people in those positions to be subject to the “revolving-door/post-termination” restrictions of Section 9311 of Act 114.  

2.           Determining, upon request, whether someone is subject to the “revolving-door/post-termination” restrictions of Section 9311 of Act 114.
