Contract Compliance Program Area
The Contract Compliance Section is responsible for assuring that highway construction contractors with a Federal-aid PennDOT contract of $10,000 or more, are in compliance with the Equal Employment Opportunity and Nondiscrimination Designated Special Provisions (DSP's) of their contracts.
To achieve their goal, contract compliance reviews are conducted according to regulatory guidance under Title 23, of the Code of Federal Regulation, Part 230. The review examines the contractor's Good Faith Efforts (GFE's) in fulfilling the required contract obligations of the Form FHWA 1273 (DSP #8), assuring equal employment opportunity and nondiscrimination on Federal-aid PennDOT highway construction projects.
Additionally, Contractor Compliance guidance, training, and investigation occurs as needed.
Federal Highway Administration (FHWA)
All contractors and subcontractors on PennDOT federal-aid projects ≥ $10,000 must comply with the Required Contract Provision Federal-Aid Construction Contracts, Form FHWA 1273. The form is in the Designated Special Provision #8 of all federal-aid PennDOT contracts ≥ $10,000. In addition, the contractor and all subcontractors must comply with the following policies: 41 CFR Part 60, 29 CFR Parts 1625-1627, 23 U.S.C. 140, Section 504 of the Rehabilitation Act of 1973, as amended (29 U.S.C. 794), Title VI of the Civil Rights Act of 1934. As amended (42 U.S.C. 2000d et seq.) and related regulations including 49 CFR Parts 21, 26, and 27; and 23 CFR Parts 200, 230, and 633.
